SHIPPING POLICY

Thank you for shopping with ELITE WORKWEAR.

This Shipping Policy explains how orders placed through ELITE WORKWEAR are processed, shipped, delivered, and handled when delivery issues occur.

ELITE WORKWEAR is operated by RGV Premium Sales LLC, doing business as ELITE WORKWEAR (“ELITE WORKWEAR,” “we,” “us,” or “our”).

By placing an order with ELITE WORKWEAR, you acknowledge and agree to this Shipping Policy, together with our Terms of Service, Return & Refund Policy, Cancellation Policy, Lost, Stolen or Missing Packages Policy, Privacy Policy, and any other terms applicable to your order.

Nothing in this Shipping Policy is intended to waive or restrict any right or remedy that cannot lawfully be waived under applicable law.


1. ORDER PROCESSING

Orders are processed on business days.

For purposes of this Policy, “business days” generally means Monday through Friday, excluding applicable U.S. federal holidays and days on which our fulfillment operations are closed.

Order processing begins after we receive the order and, where applicable:

  • Payment has been successfully authorized;

  • Required fraud or identity verification has been completed;

  • Shipping information has been reasonably verified;

  • Required tax or resale documentation has been received; and

  • The product is available for fulfillment.

Processing time is separate from carrier transit time.

An order may remain pending or unfulfilled while payment, address, inventory, fraud-prevention, or other reasonable verification is being completed.


2. ESTIMATED PROCESSING AND SHIPPING TIMES

Any processing, fulfillment, shipping, transit, or delivery time displayed on:

  • A product page;

  • The shopping cart;

  • Checkout;

  • An order confirmation;

  • A shipping quote;

  • A written quotation; or

  • Another written communication from ELITE WORKWEAR

is an estimate unless expressly stated otherwise.

Where a specific order or product is quoted a particular processing or delivery timeframe, that timeframe applies to that order subject to the terms of this Policy.

Certain products, bulk orders, special orders, pre-orders, backordered products, custom orders, wholesale orders, or products requiring additional fulfillment may have longer processing or delivery periods.

ELITE WORKWEAR does not guarantee an exact delivery date unless the guarantee is expressly stated in writing for the applicable order.

If we become unable to ship an order within a timeframe we have specifically represented, we will handle the delay in accordance with applicable law.


3. PROCESSING TIME VS. TRANSIT TIME

Processing time and carrier transit time are different.

Processing time refers to the time necessary for ELITE WORKWEAR to prepare an order for shipment.

Transit time refers to the time between carrier acceptance of the shipment and delivery.

An estimated transit time does not necessarily include:

  • Order processing;

  • Weekends;

  • Holidays;

  • Carrier delays;

  • Weather delays;

  • Customs processing;

  • Address corrections;

  • Delivery exceptions; or

  • Other circumstances outside the carrier's normal transit schedule.


4. SHIPPING METHODS AND CARRIERS

ELITE WORKWEAR may use national, regional, local, or third-party shipping carriers depending on:

  • Destination;

  • Package dimensions;

  • Package weight;

  • Product type;

  • Shipping service selected;

  • Carrier availability;

  • Delivery requirements; and

  • Other fulfillment considerations.

Available shipping methods and applicable charges may be displayed during checkout.

Unless a specific carrier or service is expressly guaranteed, ELITE WORKWEAR reserves the right to use another appropriate carrier or comparable shipping service when reasonably necessary to fulfill an order.


5. SHIPPING RATES

Shipping charges, when applicable, are generally calculated or displayed at checkout based on factors that may include:

  • Delivery destination;

  • Order value;

  • Package weight;

  • Package dimensions;

  • Shipping method;

  • Product type; and

  • Applicable carrier rates.

Shipping rates may change from time to time.

A shipping charge displayed or accepted for one order does not guarantee the same shipping charge for future orders.


6. FREE SHIPPING OFFERS

ELITE WORKWEAR may offer free shipping promotions from time to time.

Free shipping offers may be subject to:

  • Minimum purchase requirements;

  • Eligible destinations;

  • Eligible products;

  • Promotional codes;

  • Specific customer groups;

  • Excluded oversized or special products;

  • Expiration dates; or

  • Other promotional conditions.

Unless expressly stated otherwise, free shipping promotions apply only to the shipping method designated by ELITE WORKWEAR.

Free shipping does not mean expedited shipping.


7. DELIVERY ESTIMATES

Delivery dates and transit times provided by ELITE WORKWEAR or a shipping carrier are estimates unless expressly guaranteed.

Actual delivery times may be affected by circumstances outside our reasonable control, including:

  • Carrier delays;

  • Weather;

  • Natural disasters;

  • Transportation disruptions;

  • Holidays;

  • High shipping volume;

  • Customs processing;

  • Government actions;

  • Labor disruptions;

  • Incorrect or incomplete addresses;

  • Security restrictions;

  • Remote delivery locations; or

  • Other logistical events.

To the fullest extent permitted by applicable law, ELITE WORKWEAR is not responsible for carrier delays or other delays outside our reasonable control after a shipment has been properly tendered to the carrier.


8. SHIPPING DELAYS BEFORE SHIPMENT

If an order cannot be shipped within a specifically represented shipping timeframe, ELITE WORKWEAR may provide:

  • A revised estimated shipment date;

  • Information regarding the delay;

  • An opportunity to continue waiting; or

  • Cancellation and refund options,

as required by applicable law.

ELITE WORKWEAR may also cancel and refund an order if we determine that the product cannot reasonably be fulfilled.


9. ORDER TRACKING

When tracking is available, tracking information will generally be provided after shipment.

Tracking information may not become active immediately after a label is created.

A shipping label being created does not necessarily mean that the carrier has already physically received or scanned the package.

Customers are responsible for monitoring tracking information and making reasonable arrangements to receive their shipment.


10. CUSTOMER RESPONSIBILITY FOR SHIPPING INFORMATION

Customers are responsible for providing a complete and accurate shipping address.

Before submitting an order, customers should verify:

  • Recipient name;

  • Street address;

  • Apartment, suite, unit, or building number;

  • City;

  • State;

  • ZIP or postal code;

  • Country, where applicable; and

  • Other delivery information requested at checkout.

ELITE WORKWEAR is not responsible, to the fullest extent permitted by law, for delivery problems caused by incorrect, incomplete, outdated, or improperly entered shipping information supplied by the customer.


11. ADDRESS CHANGES AFTER AN ORDER IS PLACED

Customers should contact ELITE WORKWEAR as soon as possible if an address correction is needed.

Address changes are not guaranteed after an order has been submitted.

Once fulfillment has begun or a shipment has been transferred to a carrier, we may be unable to modify the shipping address.

For fraud-prevention purposes, ELITE WORKWEAR may refuse a request to change an order from the original verified shipping address to another address.

We may require cancellation and placement of a new order instead.


12. CARRIER ADDRESS CORRECTIONS AND REROUTING

Carrier-requested address corrections, customer-requested rerouting, delivery interceptions, or other delivery modifications may result in additional charges.

Where such charges result from incorrect information supplied by the customer or from a customer-requested change, the customer may be responsible for those charges to the extent permitted by law.

ELITE WORKWEAR does not guarantee that a carrier will approve or successfully complete a rerouting or address-change request.


13. P.O. BOXES AND RESTRICTED ADDRESSES

Certain shipping carriers or shipping methods may not support delivery to P.O. boxes or other restricted address types.

If the selected service cannot deliver to the address provided, we may:

  • Request an alternative address;

  • Use another available shipping method;

  • Hold the order while awaiting corrected information; or

  • Cancel and refund the affected order where appropriate.


14. APARTMENTS, HOTELS, OFFICES, JOBSITES AND SHARED DELIVERY LOCATIONS

Customers shipping to an:

  • Apartment complex;

  • Hotel;

  • Motel;

  • Office;

  • Warehouse;

  • Business;

  • Jobsite;

  • Dormitory;

  • Reception desk;

  • Mailroom;

  • Package room;

  • Concierge;

  • Front desk; or

  • Other shared or managed delivery location

are responsible for understanding and following that location's package-receiving procedures.

To the fullest extent permitted by applicable law, a shipment may be considered delivered when the carrier completes delivery to an individual or authorized receiving area at the shipping address, including a front desk, reception desk, mailroom, package room, concierge, loading dock, receiving department, or similar authorized location.

ELITE WORKWEAR is not responsible for the subsequent internal handling, storage, movement, misplacement, or release of a package by a hotel, employer, apartment complex, business, mailroom, receiving department, or other third party after proper carrier delivery, except where applicable law requires otherwise.


15. SIGNATURE REQUIREMENTS

ELITE WORKWEAR may require a signature for certain shipments based on:

  • Order value;

  • Product type;

  • Destination;

  • Fraud risk;

  • Carrier requirements; or

  • Other reasonable security considerations.

Signature requirements may be added without separate customer request where reasonably necessary to protect the shipment.

A signature obtained by the carrier from a person reasonably authorized to receive packages at the delivery location may be used as evidence of delivery.

Customers are responsible for making reasonable arrangements to receive shipments requiring a signature.

If a shipment is returned because repeated signature or delivery attempts were unsuccessful, reshipping charges may apply.


16. PACKAGES MARKED AS DELIVERED

If carrier tracking shows a shipment as Delivered, but the customer cannot locate the package, the customer should promptly:

  1. Check the delivery location and surrounding areas;

  2. Check all entrances or secure delivery areas;

  3. Ask household members or other occupants;

  4. Check with neighbors where appropriate;

  5. Contact the building manager, front desk, reception area, mailroom, package room, or concierge where applicable; and

  6. Contact the shipping carrier if the package still cannot be located.

The customer should then contact ELITE WORKWEAR promptly with the order number and tracking information.

When investigating a delivered-but-not-received claim, ELITE WORKWEAR may review:

  • Carrier tracking;

  • Delivery scans;

  • GPS delivery information;

  • Carrier photographs;

  • Delivery timestamps;

  • Signature records;

  • Delivery location information;

  • Carrier investigation results;

  • Customer communications; and

  • Other reasonably relevant evidence.

A claim that a package was not received does not automatically entitle the customer to a refund or replacement.

Each claim may be reviewed individually based on the available evidence and applicable law.


17. THEFT AFTER DELIVERY

To the fullest extent permitted by applicable law, ELITE WORKWEAR is not responsible for theft occurring after a package has been properly delivered to the shipping address or an authorized receiving location associated with that address.

Customers are encouraged to use a secure delivery location when package theft is a concern.

For suspected theft claims, ELITE WORKWEAR may request reasonable supporting information, including:

  • A carrier case number;

  • Confirmation of a carrier investigation;

  • Available security information; or

  • Where appropriate based on the circumstances or value of the shipment, a police report.

Requesting documentation does not guarantee approval or denial of a claim.

Nothing in this section limits rights that cannot legally be waived.


18. PACKAGES LOST IN TRANSIT

A package may be considered potentially lost in transit when tracking information and carrier circumstances reasonably indicate that delivery may no longer occur normally.

If a shipment appears to be lost in transit, customers should contact ELITE WORKWEAR.

We may:

  • Review tracking information;

  • Contact the carrier;

  • Initiate or assist with a carrier investigation;

  • Submit a carrier claim where appropriate;

  • Request additional information from the customer; or

  • Take another appropriate action based on the circumstances.

Replacement, refund, credit, or other resolution will be determined based on the circumstances, carrier information, available evidence, our applicable policies, and applicable law.

Customers may be required to cooperate reasonably with a carrier investigation.


19. SHIPPING INSURANCE AND CARRIER CLAIMS

ELITE WORKWEAR may purchase or utilize carrier liability coverage, declared-value coverage, third-party shipping protection, or shipping insurance for certain shipments at our discretion.

The existence of such coverage does not guarantee that a carrier or insurer will approve a claim.

Carrier and insurer claims may be subject to:

  • Filing deadlines;

  • Documentation requirements;

  • Investigation procedures;

  • Coverage limits;

  • Exclusions; and

  • Other applicable terms.

Customers may be required to preserve packaging, photographs, products, or other evidence while a claim is investigated.

Shipping insurance or carrier coverage does not expand or reduce any legal right that cannot lawfully be altered by this Policy.


20. DAMAGED PACKAGES

Customers should inspect packages and merchandise promptly after delivery.

Visible shipping damage should be reported to ELITE WORKWEAR as soon as reasonably possible and preferably within 5 calendar days after delivery.

Customers may be asked to provide:

  • Order number;

  • Photographs of the shipping carton;

  • Photographs of the shipping label;

  • Photographs of internal packaging;

  • Photographs of the damaged product;

  • A description of the damage; and

  • Other information reasonably necessary to investigate the claim.

Customers should retain the damaged product and all original packaging until instructed otherwise, as the carrier or ELITE WORKWEAR may require inspection.

Disposing of evidence before a claim can be reasonably investigated may affect our ability to pursue the carrier claim or verify the reported damage.


21. MISSING ITEMS

If an order arrives with an item missing, the customer should report the issue to ELITE WORKWEAR preferably within 5 calendar days after delivery.

When investigating missing-item claims, ELITE WORKWEAR may review:

  • Order information;

  • Inventory records;

  • Product scans;

  • Package weight;

  • Carrier weight records;

  • Shipping documentation;

  • Fulfillment records;

  • Packing records;

  • Photographs;

  • Video records lawfully collected and retained; and

  • Other reasonably relevant evidence.

Submitting a missing-item claim does not automatically guarantee a refund, replacement, or credit.

Claims are reviewed based on available evidence and applicable law.


22. INCORRECT ITEMS

If ELITE WORKWEAR sends an item different from the item ordered, the customer should contact us promptly and preferably within 5 calendar days after delivery.

Customers may be asked to provide photographs or other reasonable documentation so we can verify the issue.

Where ELITE WORKWEAR confirms that an incorrect product was shipped because of our fulfillment error, we will address the issue in accordance with our applicable policies and applicable law.


23. CLAIM REPORTING PERIODS

To help us investigate shipping and fulfillment issues while tracking, packaging, inventory, and carrier information remain available, customers should report:

  • Missing-item claims;

  • Incorrect-item claims;

  • Visible shipping damage; and

  • Delivered-but-not-received issues

as promptly as reasonably possible and preferably within 5 calendar days after the carrier's recorded delivery date.

Failure to report an issue within this preferred period may reduce the availability of evidence or carrier remedies.

However, this reporting request does not waive or shorten any period that applicable law does not permit us to waive or shorten.


24. FULFILLMENT RECORDS AND SHIPPING EVIDENCE

To investigate a delivery, damage, missing-item, fraud, refund, or payment dispute, ELITE WORKWEAR may rely on reasonably relevant business records.

These may include:

  • Order records;

  • Inventory records;

  • Payment records;

  • Fraud-screening information;

  • Product scans;

  • Package weights;

  • Shipping labels;

  • Carrier acceptance records;

  • Tracking records;

  • Delivery photographs;

  • GPS information;

  • Signatures;

  • Fulfillment records;

  • Packing documentation;

  • Photographs;

  • Video records lawfully collected and retained;

  • Customer communications;

  • Return records; and

  • Other reasonably relevant evidence.

ELITE WORKWEAR may provide appropriate records to carriers, insurers, payment processors, financial institutions, marketplaces, or other authorized parties when reasonably necessary to investigate or respond to a legitimate claim or dispute.


25. RETURNED-TO-SENDER PACKAGES

A shipment may be returned to ELITE WORKWEAR for reasons including:

  • Incorrect address;

  • Incomplete address;

  • Refused delivery;

  • Failure to collect the package;

  • Failed delivery attempts;

  • Inability to obtain a required signature;

  • Carrier restrictions; or

  • Other delivery problems.

If a package is returned because of information or circumstances attributable to the customer, ELITE WORKWEAR may require payment of additional shipping charges before reshipping.

Where a refund is otherwise available, original carrier charges, return-to-sender charges, address-correction charges, or other nonrecoverable shipping costs may be deducted or excluded to the extent permitted by applicable law and our Return & Refund Policy.

If the return results from an error by ELITE WORKWEAR, we will address the issue appropriately.


26. REFUSED DELIVERIES

Refusing delivery does not automatically constitute an approved return or cancellation.

Refused shipments remain subject to our Return & Refund Policy and Cancellation Policy.

Costs arising from an unauthorized refusal may be deducted from an otherwise eligible refund to the extent permitted by applicable law.


27. MULTIPLE SHIPMENTS

An order may be fulfilled in more than one package or shipment.

Different items from the same order may arrive:

  • On different dates;

  • Through different carriers;

  • From different fulfillment locations; or

  • Under separate tracking numbers.

A customer should review all tracking numbers associated with an order before reporting an item as missing.


28. LARGE, BULK, WHOLESALE AND COMMERCIAL ORDERS

Large, bulk, wholesale, reseller, and commercial orders may require:

  • Additional processing time;

  • Multiple packages;

  • Palletized freight;

  • Freight delivery;

  • Appointment delivery;

  • Commercial receiving facilities;

  • Additional verification; or

  • Special shipping arrangements.

Shipping estimates for these orders may differ from standard consumer orders.

Separate written shipping terms, quotations, purchase orders, wholesale agreements, or commercial agreements may apply.

Where a separately executed written agreement expressly conflicts with this Shipping Policy regarding a specific commercial shipment, the applicable written agreement will control that issue.


29. FREIGHT SHIPMENTS

Where freight shipping is used, the recipient may be responsible for inspecting the shipment before accepting delivery.

Visible freight damage or shortages should be noted on the carrier's delivery documentation where reasonably possible.

Depending on the shipment and carrier, additional services such as:

  • Liftgate service;

  • Inside delivery;

  • Residential delivery;

  • Appointment delivery; or

  • Limited-access delivery

may result in additional charges.

Any applicable additional freight requirements will be handled according to the shipping arrangement and applicable law.


30. FREIGHT FORWARDERS AND PACKAGE FORWARDING SERVICES

If a customer directs an order to a freight forwarder, package forwarding company, export agent, reshipping company, or similar intermediary, the customer assumes responsibility for the intermediary selected.

To the fullest extent permitted by applicable law, ELITE WORKWEAR's responsibility for post-delivery handling ends when the carrier confirms proper delivery to the forwarding service or intermediary designated by the customer.

ELITE WORKWEAR is not responsible for loss, theft, damage, alteration, repackaging, customs issues, delay, or misdelivery occurring after proper delivery to a customer-selected freight forwarder or forwarding service, except where applicable law requires otherwise.


31. INTERNATIONAL SHIPPING

International shipping may be offered for certain products and destinations.

International customers are responsible for determining whether the products purchased may legally be:

  • Imported;

  • Received;

  • Possessed;

  • Resold; or

  • Used

in the destination country.

International shipments may be subject to:

  • Import duties;

  • Customs fees;

  • Taxes;

  • Brokerage charges;

  • Government fees;

  • Customs inspections;

  • Import restrictions; and

  • Additional delays.

Unless expressly stated otherwise, these charges are the customer's responsibility.

ELITE WORKWEAR is not responsible for customs delays outside our reasonable control.

We reserve the right to refuse or cancel an international order when fulfillment presents a legitimate legal, regulatory, carrier, customs, fraud, or payment risk.


32. CUSTOMS REFUSALS AND INTERNATIONAL RETURNS

If an international shipment is refused, abandoned, rejected by customs, or returned because the customer failed to pay applicable duties, taxes, customs charges, or other required fees, additional charges may apply.

Any refund eligibility will be determined after the merchandise is returned and inspected, subject to our Return & Refund Policy and applicable law.

Nonrecoverable shipping, customs, brokerage, return, or carrier charges may be excluded from an otherwise eligible refund to the extent permitted by applicable law.


33. DELIVERY TO SECURE LOCATIONS

Customers concerned about package theft or unattended deliveries should consider using an available secure delivery location or a shipping destination where someone can receive the package.

ELITE WORKWEAR does not guarantee that a carrier will honor every delivery instruction, hold request, signature request, or preferred delivery location submitted directly to the carrier.


34. DELIVERY INSTRUCTIONS

Customer delivery instructions are requests and are not guaranteed.

Shipping carriers may determine the final delivery location based on:

  • Safety;

  • Accessibility;

  • Carrier policies;

  • Weather;

  • Property access; and

  • Other delivery considerations.

ELITE WORKWEAR is not responsible for a carrier's independent failure to follow a customer's optional delivery instruction where the shipment was otherwise properly delivered, except where applicable law requires otherwise.


35. ORDER HOLDS

ELITE WORKWEAR may temporarily hold shipment of an order when reasonably necessary to resolve:

  • Payment verification;

  • Fraud concerns;

  • Address discrepancies;

  • Inventory issues;

  • Customer-requested changes;

  • Tax documentation;

  • Resale documentation;

  • Export restrictions; or

  • Other legitimate fulfillment concerns.

A temporary verification hold is not the same as a carrier delay.


36. SHIPPING AND PAYMENT DISPUTES

A customer retains any lawful right to dispute a transaction.

If a shipping-related payment dispute or chargeback is filed, ELITE WORKWEAR may provide reasonably relevant documentation to the applicable financial institution, card network, payment processor, marketplace, or other authorized party.

Such evidence may include:

  • Tracking information;

  • Proof of shipment;

  • Proof of delivery;

  • Delivery photographs;

  • Signatures;

  • GPS delivery information;

  • Package weight;

  • Fulfillment records;

  • Order information;

  • Customer communications; and

  • Other reasonably relevant evidence.

The filing of a dispute does not itself establish that either party has acted improperly.


37. FORCE MAJEURE AND EVENTS OUTSIDE OUR CONTROL

To the fullest extent permitted by applicable law, ELITE WORKWEAR will not be responsible for delays caused by events outside our reasonable control, including:

  • Severe weather;

  • Hurricanes;

  • Floods;

  • Fires;

  • Natural disasters;

  • Carrier network disruptions;

  • Transportation shutdowns;

  • Labor disputes;

  • Government actions;

  • Civil disturbances;

  • War;

  • Public emergencies;

  • Widespread technology failures;

  • Utility failures; or

  • Similar extraordinary events.

We will make commercially reasonable efforts to resume normal fulfillment when reasonably practicable.


38. RISK OF LOSS

Risk of loss will be determined in accordance with applicable law and the applicable shipping arrangement.

To the fullest extent permitted by applicable law, ELITE WORKWEAR is not responsible for theft, loss, or unauthorized removal occurring after a shipment has been properly delivered to the address or authorized receiving location selected by the customer.

Nothing in this section shifts responsibility for an order that applicable law requires ELITE WORKWEAR to bear.


39. NO GUARANTEE OF CARRIER PERFORMANCE

Shipping carriers are independent service providers.

ELITE WORKWEAR cannot guarantee a carrier's exact:

  • Pickup time;

  • Scan timing;

  • Routing;

  • Transportation schedule;

  • Delivery time;

  • Delivery location within the property;

  • Investigation duration; or

  • Claim determination.

Where appropriate, we may assist customers in communicating with carriers, but carrier investigations and decisions may be subject to the carrier's own procedures.


40. FRAUDULENT SHIPPING CLAIMS

ELITE WORKWEAR reserves the right to investigate claims that reasonably appear inconsistent with available shipping, fulfillment, payment, or delivery evidence.

Where legally permitted, we may deny a claim when reliable evidence reasonably demonstrates that the order was properly fulfilled and delivered or that the claim is otherwise materially inaccurate.

Knowingly submitting false information regarding a shipment, delivery, missing item, theft, or transaction may result in:

  • Refusal of the claim;

  • Restriction of future orders;

  • Preservation of evidence;

  • Submission of relevant evidence in a payment dispute; or

  • Other lawful action.

This provision does not prevent customers from making legitimate claims or exercising lawful consumer rights.


41. CANCELLATIONS BEFORE SHIPMENT

Requests to cancel an order are governed by our Cancellation Policy.

Submitting a cancellation request does not guarantee cancellation.

Orders may enter processing or fulfillment shortly after they are placed.

Once an order has entered fulfillment or shipment, cancellation may no longer be possible and the transaction may instead be governed by our Return & Refund Policy.


42. RETURNS ARE SEPARATE FROM SHIPPING CLAIMS

A standard return request is different from:

  • A lost-package claim;

  • A shipping-damage claim;

  • A missing-item claim;

  • An incorrect-item claim; or

  • A delivered-but-not-received claim.

Standard returns are governed by our Return & Refund Policy.

Shipping-related claims are investigated under this Shipping Policy and our Lost, Stolen or Missing Packages Policy, as applicable.


43. POLICY ABUSE

ELITE WORKWEAR may restrict future transactions or account access when reasonably necessary because of documented patterns of:

  • Fraud;

  • Materially false claims;

  • Repeated unauthorized payment disputes;

  • Abuse of return or shipping procedures;

  • Identity misrepresentation; or

  • Other unlawful or abusive conduct.

Any action under this section will be taken subject to applicable law.


44. GOVERNING TERMS

This Shipping Policy forms part of the terms governing transactions with ELITE WORKWEAR.
